This paper looks at the wide range of economic and social rights implicated in post conflict reconstruction, to assess the extent of their justiciability with reference to case law from diverse jurisdictions and then to examine the issue of discrimination and obligations as to guaranteeing equality of enjoyment, including to ensure women's right to equal access to justice.
